REGULATIONS - JAZZ WORKSHOPS FOR ADULTS 

 

I. Definition ot Terms

  1. Regulations” means this document.
  2. Organizer” means Ilona Grzywacz who conducts a sole proprietorship under the name Muzykariat Ilona Grzywacz that is registered in Sopot, Poland (81-747) at ul. Stefana Okrzei 12a/13 with the tax identification number NIP 8451853938 and the National Official Business Register number REGON 362913846
  3. Workshop” means an educational Jazz Workshop for Adults provided by the  Organizer and described on the internet site www.warsztatyjazzowe.pl.
  4. Participant” means an adult person who is eligible to participate by registering to participate in Jazz Workshops for Adults.
  5. Applicant” means a physical or legal person or an organization without legal personality who, on his/her own behalf or on that of another person, applies to participate in the workshop.

II. General Provisions

  1. The workshop regulations apply to all participants.
  2. Participans must accept the regulations prior to participating in the workshop.

III. Workshop Fee.

  1. A fee will be paid to participate in the workshop.
  2. The fee for the workshop is 1500  (in written form: one thousand five hundred Euro).
  3. The workshop fee includes the following, which is provided by the organizer:
    - all meals (breakfast, lunch//dinner, and dinner with one glass of wine), beginning with lunch (Thursday) and ending with lunch (Sunday);
    - three nights’ accommodation in a single room with an en-suite bathroom;
    - coffee/tea and water during scheduled breaks in classes;
    - all materials necessary to participate in the workshop (sheet music, chord charts, lyrics);
    - content is supervised by those leading the workshop,
    - 12 hours of classes;
    - 9 hours of  jam sessions.
  4. The fee for the workshop does not include the following:
    - transportation to and from Rybakówka Guest House;
    - alcohol (except for one glass of wine with each dinner);
  5. If a participant or applicant withdraws from the workshop, the workshop fee is not refunded.
  6. If it is impossible for an applicant to participate in the workshop, he/she may designate another adult to participate in the workshop in his/her place.
  7. If the required number of participants does not register for the workshop, the organizer reserves the right to postpone the workshop to a later date. 
  8. If the organizer cancels the workshop, the full fee will be refunded.

IV. Applying for a Workshop

  1. To apply for a workshop, applicants must complete and submit an application form (available on the workshop website) and pay 50% of the fee of 75 for the workshop. Payment of the fee in full must be made within two days of receipt of confirmation from the organizer that places are available for applicants. If the fee is not paid within the designated period, the registration will be cancelled.
  2. The portion of the fee in the amount of 75 must be paid by September 5-9, 2022.
  3. Applicants will pay the fee by electronic bank transfer to the organizer’s account: PL72 1160 2202 0000 0001 9177 0157.
  4. Applications for participation in the workshop will be accepted until September 5, 2022, or until all available places are filled.
  5. The number of participants in the workshop is limited to thirteen (13).
  6.  Participation in the workshop is determined by the order in which correctly completed applications for given instruments are submitted and for which payment is received on time. During the current workshop, there are places for four guitarists, two pianists, one saxophonist, two bassists, and two other instrumentalists or vocalists. If there are no applicants who play these instruments, applications from other instrumentalists will be accepted.
  7. One month prior to the workshop, the organizer will send materials (sheet music, chord charts, lyrics) by email to the participants, which will allow them to prepare for the classes. The organizer will also send instructional videos by email. To receive these materials, applicants must have gmail accounts.

V. Workshop Format

  1. The workshop will be held at the Pensjonat Agroturystyczny Rybakówka (English -  Rybakówka Rural Guest House) 86-013, Mąkowarsko, Sokole Kuźnica 3, Bory Tucholskie.
  2. The following persons are not permitted to participate in workshops: minors; people who do not comply with these regulations; participants whose behavior threatens the safety of other participants and/or workshop leaders or poses a risk of damaging the equipment in the rooms where the workshop is held. In instances when requests to alter behavior are ignored, the workshop leaders and/or the organizer will request that such persons leave the venue where the workshop is being held.
  3. Workshop participants must bring their own instruments and amplifiers.
  4. The organizer accepts no liability for items participants leave at the venue where the workshop is held or for items that participants use during classes.
  5. Participants must comply with the regulations and the instructions of instructors. The organizer accepts no liability for any claims that arise from participants failing to comply with these regulations or the instructions of instructors.
  6. Workshop participants bear civil and legal responsibility for personal or bodily injury or damage to property that results from their actions or negligence.
  7. The organizer reserves the right to cancel or change the dates or venue of workshops for reasons beyond her control (unforeseen events, instructor concert, instructor illness). In such instances, workshop participants have the right to receive a refund of fees paid to bank account number they provide or to choose another workshop with available places no later than six months from date of the cancelled workshop.

VI. Use of Participant Likeness

  1. By participating in the workshop, participants consent to the organizer using their likenesses in photographs taken and videos recorded during the workshop free of charge in the media: internet, print press, television. 
  2. Participants’ likenesses will only be used for promotional purposes and for the proper functioning of Jazz Workshops for Adults and Muzykariat.


VII. Complaints

  1. The participantcan file a complaint against the organizer if the terms of the agreement are not performed or are performed improperly.
  2. Complaints can be filed in writing at the registered address of the organizer or electronically by email at This email address is being protected from spambots. You need JavaScript enabled to view it..
  3. Complaints must include the following: address, telephone number, and email address of the participant filing the complaint; the dates of the workshop regarding which the complaint is being filed; a description of the complaint; an explanation of the reason or reasons to justify the complaint; if the complaint is made in writing, the participant filing the complaint must sign it.
  4. Complaints must be filed within seven days of the end of the workshop. Complaints filed after this date will not be considered.
  5. The organizer will acknowledge receipt of a complaint electronically by sending an email to the email address of the participant who filed the complaint. The organizer will consider any complaints with 14 days of their receipt. The organizer will notify the participant electronically of the decision regarding the complaint, including an explanation of any actions taken or not taken, by sending an email to the address of the participant who filed the complaint.

VIII. Data Protection and Privacy

  1. By applying to participate in Jazz Workshops for Adults, the applicant agrees to the processing of his/her personal data that is deemed essential for the performance of the agreement in accordance with the principles set forth in the Act of 27 August 1997 on Personal Data Protection (unified text: Journal of Laws of  2002, No. 101, item 926 with later amendments).
  2. Pursuant to Article 13, paragraphsand 2 of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/CE (General Data Protection Regulation), the organizer informs participants that:
    a) personal data will be processed for the purposes of measures undertaken to mitigate the coronavirus SARS-CoV-2 pandemic; 
    b) data processing will be performed based on the following legal grounds:
    - within the scope of collecting information on the most recent place of residence (especially in regions at heightened risk) based on Article 6, paragraph 1, letter (f) of the GDPR, i.e., in the legitimate interest pursued by the controller that is guaranteeing safety and protecting against infection,
    - within the scope of collecting information on health status, i.e., in particular information regarding possible symptoms of illness, including measuring body temperature based on Article 9, paragraph 2, letter (i) of the GDPR, i.e., for reasons of public interest in the area of public health within the scope of protecting against infection
    - the recipients of the personal data are the Główny Inspektorat Sanitarny(English – Central Sanitary Inspectorate) and/or law enforcement services and other state bodies authorized to receive data associated with mitigating the spread of coronavirus SARS-CoV-2
  3. An applicantwho is not the participant declares that he/she is authorized to provide the personal data of the participant that will be processed by the organizer with the aim of fulfilling the terms of the contract.
  4. The administratorof personal data is Ilona Grzywacz who conducts a sole proprietorship under the name of  Muzykariat Ilona Grzywacz that is registered in Sopot (81-747) at ul. Stefana Okrzei 12a/13.
  5. Applicants and participants who are not applicants have the right to review and rectify their personal data or to have them erased.

IX. Coronavirus SARS-CoV-2

  1. Participants in the workshop and accompanying persons consent to the transfer of their personal data to the Główny Inspektorat Sanitarny(English – Central Sanitary Inspectorate) and/or law enforcement services if such a necessity arises.
  2. Participants in the workshop and accompanying persons are required to provide their own personal protective equipment.
  3. Participants in the workshop and accompanying persons are required to submit written declarations (either by email or immediately upon arrival at the workshop venue) that, to the best of their knowledge, they are not infected with coronavirus SARS-CoV-2, and they are not under quarantine or epidemiological supervision. 

X.  Amending the Provisions of the Regulations

  1. The organizer reserves the right to change the provisions of these regulations. Amended regulations are in force upon their publication on the organizer’s website at www.warsztatyjazzowe.pl and after notifying applicants who have applied to participate in a workshop that has not yet been held.
  2. Applicants who have not yet participated in a workshop have the right to terminate the agreement if they do not accept the amendments to the provisions of the regulations within seven calendar days of their receipt of notification regarding the amended regulations.

XI. Final Provisions

  3. In matters not regulated by these regulations, the provisions of Polish law apply, including the provisions of the Civil Code. The Polish version of these regulations is binding, while the English version is for informational purposes only.
